A legal disclaimer

Effective Date: September 1st, 2025

Please read the following Terms & Conditions carefully. By booking travel through Gold Horizon Travel (“we,” “our,” “us,” or “the Agency”), you (“you,” “your,” or “Client”) acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. These terms form a binding legal agreement between you and Gold Horizon Travel and apply to all travel arrangements made on your behalf.

Reservation Policy

All reservations arranged through Gold Horizon Travel are subject to availability and confirmation by the respective supplier(s). Upon booking, a confirmation will be provided to the Passenger(s) outlining the details of the travel arrangements. It is the sole responsibility of the Passenger(s) to thoroughly review all reservation details immediately upon receipt.

Passenger(s) must review all information contained in the travel confirmation within twenty-four (24) hours of booking and notify Gold Horizon Travel of any errors, discrepancies, or inaccuracies without delay. This includes, but is not limited to, verification of legal names (as reflected on passports or government-issued IDs), travel dates, destinations, accommodations, flight times, and special requests.

Gold Horizon Travel shall not be held liable for any additional costs, denied boarding, schedule disruptions, missed reservations, or cancellations arising from inaccuracies in the reservation information that were not reported within the 24-hour review period. Passenger(s) expressly acknowledge and agree that they assume full responsibility for any additional charges, penalties, or losses incurred as a result of errors or omissions not addressed within twenty-four (24) hours of booking.

All subsequent changes to a confirmed reservation may be subject to change fees, fare increases, or penalties imposed by the suppliers, and such charges shall be the responsibility of the Passenger(s).

Quotes and Pricing

Quotes are not guaranteed until a deposit is made. Pricing and availability are subject to change without notice and are not guaranteed until booked and confirmed. While we strive for accuracy, we are not responsible for Supplier pricing errors or changes.

 
Deposits and Payments

A deposit is required to initiate a booking. Deposit amounts and due dates vary by Supplier and type of travel. Final payments are due by the date specified on your invoice or confirmation.

Failure to pay on time may result in Supplier-imposed penalties or cancellation. We are not responsible for loss due to missed payments.

Credit Card Purchases and Chargebacks

Gold Horizon Travel strongly recommends the use of credit cards for travel purchases to ensure your rights under the Fair Credit Billing Act. If Gold Horizon Travel is the merchant processing your payment, our role is solely to collect and remit funds to the travel supplier. If the supplier fails to deliver services as promised, you agree that your remedy lies solely with the supplier and not with Gold Horizon Travel. By booking with us, you agree not to initiate a credit card chargeback against Gold Horizon Travel for any failure of performance by a supplier.

Travel Insurance

Gold Horizon Travel strongly recommends the purchase of comprehensive travel insurance to protect against trip cancellation, interruption, delays, medical emergencies, evacuations, and other unexpected events, including those related to COVID-19. Most standard insurance policies do not cover pandemic-related cancellations unless you purchase a "Cancel For Any Reason" (CFAR) upgrade. While we may provide information on available travel insurance policies, we are not licensed insurance agents and cannot guarantee coverage, explain specific terms, or advocate on your behalf. It is your responsibility to evaluate and choose a policy that meets your specific needs.

Cash-back and/or voucher-style insurance policies may be available, depending on the provider and coverage type. If you choose a voucher-based insurance policy, you understand and agree that any reimbursement will be issued in the form of a future travel credit with the supplier, not as a cash refund. You acknowledge this distinction and agree not to initiate a credit card chargeback on the basis of receiving a voucher or travel credit rather than a monetary refund.

If you decline to purchase travel insurance, you assume full financial responsibility for any losses incurred and agree that your travel confirmation will indicate “declined” in the travel protection section. If you believe that you purchased insurance but see “declined” listed, you must notify us immediately. Failure to do so will be considered a waiver of coverage.

Insurance Claims

All requests for coverage or services under any travel insurance policy must be submitted directly to the applicable insurance provider, pursuant to the terms, conditions, and procedures set forth in the policy issued to the traveler. The traveler bears sole responsibility for reviewing and understanding the coverage limitations, exclusions, claims procedures, and documentation requirements associated with the selected policy. Gold Horizon Travel does not provide advice, guidance, or assistance with respect to possible cancellations or the processing or outcome of any insurance claims. Any inquiries or disputes related to coverage, claim denials, or reimbursement must be directed to the insurance provider.

Price Increases

All travel prices are subject to change without notice, including increases due to fuel surcharges, government-imposed fees, taxes, and supplier price adjustments. You authorize Gold Horizon Travel to charge your credit or debit card for such increases, even after you have made full or partial payment, as required by the supplier.

Cancellation and No-Show Policies

All cancellations and no-shows are subject to the terms and penalties of the applicable travel supplier. These may include forfeiture of all or part of your payment. Gold Horizon Travel also charges its own non-refundable planning and service fees, which are separate from supplier penalties. For specific cancellation terms, please refer to the supplier’s policies or contact your Gold Horizon Travel advisor.

Agency Role

Gold Horizon Travel (“Gold Horizon Travel”) acts solely as a sales agent for any airline, hotel, car rental company, tour operator, cruise line, travel insurance provider, or any other supplier or service provider (collectively, “Suppliers”) named in your itinerary. Gold Horizon Travel is not the source or provider of the travel services booked on your behalf and does not own, operate, manage, or control any of the Suppliers or the travel services they provide.

Gold Horizon Travel shall not be held responsible or liable for the acts or omissions of Suppliers, including but not limited to their failure to adhere to their own schedules, provide contracted services, issue refunds, honor future travel credits, or avoid financial default. Gold Horizon Travel makes no representations or warranties regarding the financial condition of any Supplier and assumes no liability for recommending or facilitating the acceptance of a future travel credit in lieu of a refund.

Passenger(s) acknowledge and agree that Gold Horizon Travel functions solely as an intermediary between the public and the Suppliers, and that the Suppliers are independent entities over whom Gold Horizon Travel exercises no control. Accordingly, Gold Horizon Travel shall not be liable for any injury, loss, damage, delay, inconvenience, or expense, whether personal, property, or otherwise, resulting from any act or omission, whether negligent, willful, criminal, or otherwise, of any third party not directly controlled by Gold Horizon Travel, including but not limited to any Supplier or their employees, agents, servants, or representatives.

This limitation of liability extends to all travel-related services arranged by Gold Horizon Travel, including but not limited to accommodations, transportation, cruises, activities, excursions, and travel protection products. Passenger(s) acknowledge and accept this limitation as a condition of doing business with Gold Horizon Travel and agree that any recourse for dissatisfaction or breach lies solely with the applicable Supplier(s).

Agency Fees

Gold Horizon Travel will charge a professional service fee for each trip planned and/or booked. This fee is non-refundable and non-transferable, regardless of whether travel plans change, are canceled, or are ultimately not completed. A separate service fee will be charged for each new trip or booking request, including but not limited to revised itineraries, rebooking following cancellation, or new travel arrangements for the same or different passengers.

Gold Horizon Travel reserves the right to assess additional fees in the event of significant itinerary revisions, complex arrangements, or expedited service requests. All such fees are in addition to the cost of the travel arrangements and are payable in accordance with our billing practices at the time of engagement.

Passenger(s) acknowledge and accept these fees as compensation for professional services rendered by Gold Horizon Travel and understand that such fees are distinct from and not applied toward any amounts owed to third-party travel Suppliers.

Passport and Travel Documents

It is the sole responsibility of the Passenger(s) to ensure that all required travel documents are valid and in order prior to travel. This includes, but is not limited to, passports, visas, tourist cards, and any other documentation required by airlines, cruise lines, tour operators, and governmental or immigration authorities in the countries to which the Passenger(s) are traveling or transiting.

All passengers, including minors, must be in possession of a valid passport that is not expired and that remains valid for at least six (6) months beyond the date of expected return. Many countries strictly enforce this requirement and may deny boarding or entry for passports that expire within six months of the travel date. It is strongly recommended that all passports be reviewed and renewed well in advance of travel.

Gold Horizon Travel does not provide legal or immigration advice and makes no guarantees regarding the issuance of visas or other entry permissions by foreign governments. We do not accept any responsibility for incomplete, expired, or missing documentation, or for denial of boarding or entry for any reason, including but not limited to: failure to obtain proper documents, invalid documentation, changes to immigration policies, or incomplete travel records.

Furthermore, it is the responsibility of the Passenger(s) to inquire about and comply with all laws, rules, and regulations regarding entry eligibility, including restrictions due to criminal records, felony convictions, or DUI offenses, which may preclude entry into certain countries. Many countries strictly enforce such restrictions, and denial of entry may occur even in cases of older or non-violent offenses.

Passenger(s) acknowledge that failure to obtain or present the necessary travel documents will not constitute grounds for a refund or waiver of cancellation or change penalties. No refunds will be provided for any portion of the trip missed due to improper or missing documentation.

Foreign Entry Requirements and Traveler Responsibility 

It is the sole and exclusive responsibility of the traveler to verify and comply with all applicable entry, exit, visa, passport, vaccination, health, safety, customs, and other requirements imposed by the destination country or countries, as well as any countries transited en route. This includes, but is not limited to, ensuring that all travel documents are valid for the duration of the trip and, where applicable, for at least six (6) months beyond the traveler’s scheduled return date.

Many foreign jurisdictions enforce strict immigration laws that may prohibit entry to individuals with prior criminal convictions, including but not limited to felonies, drug offenses, or charges related to driving under the influence (DUI). It is the traveler’s obligation to determine whether any past or pending criminal charges may impact their ability to legally enter a foreign country. Gold Horizon Travel makes no representations or warranties regarding a traveler’s admissibility to any jurisdiction and shall not be held liable for any refusal of entry, deportation, delay, or related consequence resulting from such issues.

Additionally, travelers should be aware that certain countries require notarized consent from both parents or legal guardians for minors to travel internationally. It is the traveler’s responsibility to obtain and produce any such documentation required by governmental authorities.

Gold Horizon Travel disclaims all liability for any denial of entry or other travel interruption resulting from noncompliance with applicable legal or immigration requirements. Travelers are strongly encouraged to consult the destination country’s embassy or consulate and to review resources provided by the U.S. Department of State and other relevant authorities for current entry restrictions and advisories.

Rules of Travel Suppliers and Governmental Authorities

Gold Horizon Travel shall not be held liable for any travel restrictions, regulations, requirements, or conditions imposed by any travel supplier, carrier, governmental authority, or regulatory agency, whether domestic or foreign, including but not limited to those related to public health crises such as COVID-19. Such requirements may include, without limitation, the completion of health declaration forms, COVID-19 testing prior to departure or upon arrival, proof of vaccination, face coverings, temperature checks, quarantines, or other health and safety protocols mandated at any point before, during, or after travel.

It is the sole responsibility of the traveler to remain informed of and comply with all applicable rules, laws, ordinances, and mandates of any governmental entity or travel supplier. Gold Horizon Travel makes no representations or warranties regarding the current or future requirements imposed by any third party and disclaims all liability arising from the traveler's failure to comply with such requirements.

For current information concerning governmental travel regulations, travelers are advised to consult authoritative sources, including the International Air Transport Association (IATA) at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm, and to review the relevant policies and procedures posted directly by the applicable travel suppliers.

Rewards Program

Program Overview. GOLD HORIZON TRAVEL (“Company”) may, at its sole discretion, offer a rewards program (“Rewards Program”) as a gesture of appreciation to eligible clients who book and complete travel through the Company. Participation in the Rewards Program is subject to and incorporated into these Terms & Conditions, and by enrolling in or redeeming Points, clients agree to be bound by all provisions herein.

Earning of Points. Reward points (“Points”) are awarded only after the completion of the booked travel. No Points will be issued for canceled, forfeited, or incomplete travel. The Company reserves the right to determine, in its sole discretion, the number of Points awarded per booking.

Redemption of Points.
(a) Points may not be redeemed for cash, refunded, assigned, or transferred.
(b) Points may not be applied toward the cost of booking a trip.
(c) Points may only be redeemed toward approved travel add-ons associated with an active reservation, including but not limited to drink packages, excursions, or upgrades.
(d) Redemption is capped at a maximum value of One Hundred Fifty Dollars ($150.00) per reservation.

Expiration and Value. Points do not expire; however, the Company reserves the right to amend, adjust, or discontinue the Rewards Program, including the valuation of Points, at any time and without prior notice.

General Conditions. The Rewards Program is offered solely as a promotional benefit and creates no vested rights in any client. The Company makes no guarantees regarding the continued availability of the Rewards Program and expressly disclaims any liability for changes, suspension, or termination of the program.

Disability and Special Needs

Travelers with disabilities or special needs must contact travel suppliers directly to arrange for accommodations. Gold Horizon Travel does not guarantee the availability or adequacy of accommodations or services. We do not have specialized knowledge of suppliers’ accessibility capabilities and are not responsible for verifying the suitability of accommodations or transportation. It is your responsibility to communicate your needs and make appropriate arrangements in advance.

Luggage

Airlines have their own baggage policies, including size, weight, and quantity limits, as well as associated fees. It is your responsibility to familiarize yourself with these policies before departure. Gold Horizon Travel is not liable for lost, delayed, or damaged baggage. All baggage claims must be filed directly with the airline. If you are traveling with high-value items, we recommend that you purchase additional coverage or obtain travel insurance that covers baggage loss or damage.

Limitation of Liability and Assumption of Risk

To the fullest extent permitted by law, Gold Horizon Travel shall not be liable for any loss, injury, damage, delay, or expense of any kind resulting from any act, omission, or negligence of any third-party provider, including but not limited to airlines, hotels, cruise lines, tour operators, transportation companies, travel insurance providers, or any other person or entity not under the direct control of Gold Horizon Travel. You understand and agree that Gold Horizon Travel acts solely as an agent for disclosed principal suppliers and service providers, and as such, is not responsible for their acts or omissions.

Furthermore, you agree to indemnify, defend, and hold harmless Gold Horizon Travel, its owners, officers, agents, and employees from and against any claims, demands, lawsuits, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your travel arrangements, including but not limited to claims brought by third-party suppliers or service providers. This indemnification includes, without limitation, any claim that seeks to hold Gold Horizon Travel responsible for your conduct, representations, contractual obligations, or failure to comply with the terms and conditions of any third-party supplier.

Limitation of Liability for Air Transport:

In addition to the general limitation of liability stated above, you further agree that Gold Horizon Travel shall not be liable for, and you hereby release and hold us harmless from, any claim arising out of or in connection with the following, whether direct, indirect, incidental, consequential, special, punitive, or exemplary: airline schedule changes; flight delays or cancellations; missed connections; denied boarding; seating reassignments; mechanical failures; strikes; weather disturbances; natural disasters; lost, delayed, or damaged baggage; security delays; governmental acts or regulations; terrorist acts; riots; civil unrest; fire; pandemics or communicable diseases; or any failure to check in or comply with airport or airline procedures. You acknowledge and accept that the performance of air transportation is subject to the terms and conditions of the respective airline's contract of carriage, and that responsibility for compliance with such conditions rests solely with you as the traveler.

Risks Related to Activities and Excursions:

You further acknowledge that the use or enjoyment of certain travel activities, excursions, or adventure experiences may be inherently dangerous and involve risk of personal injury, death, or property damage. These activities may include but are not limited to: swimming, snorkeling, scuba diving, ziplining, hiking, skiing, boating, riding animals, operating vehicles, and other recreational or high-risk activities. You voluntarily assume all such risks and agree that, to the maximum extent permitted by law, Gold Horizon Travel shall have no liability for any personal injury, death, loss, damage, delay, or inconvenience arising from or relating to any such activity, whether occurring prior to, during, or after participation.

Gold Horizon Travel expressly disclaims all liability for any losses or expenses incurred due to delay, changes in schedules, acts of God, force majeure events, or any failure by any party to perform any obligations or offer services where such failure is beyond our reasonable control.

IN NO EVENT SHALL Gold HORIZON TRAVEL OR ITS DIRECTORS, OFFICERS, AGENTS, AFFILIATES, EMPLOYEES, CONTRACTORS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF OPPORTUNITY, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Binding Arbitration Agreement

By booking travel services with Gold Horizon Travel, you agree that any and all disputes, claims, or controversies arising out of or relating in any way to your booking, these Terms & Conditions, or any services provided by the Company shall be resolved exclusively through final and binding arbitration, rather than in court.

You agree to notify the Company in writing of any claim or dispute within thirty (30) days of the conclusion of your travel. Arbitration must be formally initiated within one (1) year of the date of the alleged incident. You waive any statute of limitations that might otherwise allow for a longer period.

Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), and judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitration shall take place in the State of Wisconsin, unless otherwise agreed upon in writing by both parties.

You understand and agree that, by entering into this agreement, you are waiving your right to bring a lawsuit in court, including the right to a jury trial or to participate in a class action.

Each party shall bear its own costs, legal fees, and expenses of arbitration, except as otherwise required by law or the AAA rules.

This arbitration agreement shall survive the termination of your relationship with the Company.

 

Assumption of Risk and Release of Liability

By booking travel through Gold Horizon Travel, you acknowledge and agree that all travel involves inherent and unforeseeable risks. You further acknowledge that the decision to travel is made at your own discretion and with full awareness of all current travel advisories, restrictions, and health and safety recommendations, including but not limited to those related to the COVID-19 pandemic and other communicable diseases.

You expressly understand and agree that Gold Horizon Travel is not responsible for, nor shall it be held liable for, any injury, illness, death, property damage, delay, inconvenience, loss, or other damages incurred in connection with or arising from any acts or omissions of any third party not under our direct control. This includes, without limitation: air carriers, railways, bus operators, cruise lines, hotels, tour operators, suppliers, travel insurance providers, or any other entity or person engaged in providing accommodations, transportation, or travel-related services. It also includes but is not limited to: unsafe conditions; acts of terrorism or war; exposure to communicable illnesses or pandemics; criminal activity; mechanical failures; delays or schedule changes; labor strikes; adverse weather conditions; natural disasters; quarantines; government restrictions; or any other act, event, or condition beyond our control.

Gold Horizon Travel makes no warranty or representation as to the safety, advisability, or accessibility of any destination. We possess no special knowledge regarding potential health hazards, political stability, climate risks, local laws, customs, or the suitability of travel arrangements for individuals with disabilities or medical conditions. Travelers are solely responsible for obtaining and reviewing all necessary and updated travel guidance. For travel warnings and alerts, visit the U.S. Department of State’s website at www.travel.state.gov, select “International Travel,” and locate “Country Information.” For medical and public health information, consult the Centers for Disease Control and Prevention at www.cdc.gov/travel, under “Destinations.”

BY PROCEEDING WITH A BOOKING THROUGH Gold HORIZON TRAVEL, YOU EXPRESSLY AND VOLUNTARILY ASSUME ALL SUCH RISKS AND DANGERS, WHETHER KNOWN OR UNKNOWN, ANTICIPATED OR UNANTICIPATED. YOU HEREBY FULLY AND FOREVER RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS Gold HORIZON TRAVEL, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, CONTRACTORS, AFFILIATES, GROUP LEADERS, AND SUBCONTRACTORS FROM AND AGAINST ANY AND ALL LIABILITY, DAMAGES, LOSSES, CLAIMS, SUITS, DEMANDS, ACTIONS, CAUSES OF ACTION, COSTS, OR EXPENSES (INCLUDING ATTORNEY’S FEES), WHETHER IN LAW OR EQUITY, ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN ANY TRIP OR TRAVEL ARRANGEMENT BOOKED THROUGH Gold HORIZON TRAVEL, INCLUDING WITHOUT LIMITATION THOSE RELATED TO THE RISKS IDENTIFIED ABOVE.

Modification of Terms

Gold Horizon Travel reserves the right to modify these Terms & Conditions at any time without prior notice. The most current version will apply to all bookings. It is your responsibility to review the Terms & Conditions before each booking. No booking will be deemed accepted without your express acknowledgment and agreement to these terms. Failure to accept these terms may result in cancellation of your booking.

Severability

If any provision of these Terms & Conditions is held to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.

 

By proceeding with your booking, you confirm that you have read, understand, and agree to be bound by these Terms & Conditions.

Pure Gold VIP Membership Program – Terms & Conditions

Gold Horizon Travel, LLC
Effective Date: September 1, 2025

 

1. Membership Eligibility & Enrollment
1.1. Pure Gold VIP Membership is available to individuals 18 years of age or older.
1.2. Membership is per household. A household is defined as two adults and any children 17 years or younger residing in the same residence.
1.3. Membership is non-transferable and valid only for the enrolled household unless otherwise specified.
1.4. Children and additional travelers 18 years or older traveling on the same trip but not included in the enrolled household must pay the standard per-person planning fee.
1.5. Membership for minors requires enrollment under a parent or legal guardian’s household membership.

2. Membership Term & Renewal

2.1. Membership is valid for 12 months from the date of enrollment.
2.2. Membership will automatically renew each year unless canceled in writing prior to the renewal date. Renewal constitutes acceptance of the then-current membership fee.
2.3. Annual Membership Fee: $299 per household.
2.4. Membership fees are non-refundable once enrollment is complete.

3. Core VIP Membership Perks
  • Unlimited Trip Planning – Plan unlimited trips without additional planning fees.

  • Exclusive Travel App Access – Personalized app containing itineraries, tickets, confirmations, maps, and tips.

  • Hosted Trip Priority – First opportunity to secure spots on Gold Horizon Travel’s hosted group trips.

  • Concierge Services – Coordination of group outings, day trips, and destination activities.

  • Exclusive Event Access – Early invitations to limited-seating travel nights and destination showcases.

  • Early Itinerary Releases & VIP Newsletter – Advance access to select itineraries and newsletters.

  • Premium Travel Documents Packet – Printed, customized travel documents provided only to VIP Members.

  • Boost Your Rewards – Earn 2x reward points for use on future trip add-ons (e.g., spa, excursions).
     

4. Annual Loyalty Bonuses

Loyalty bonuses are awarded for each consecutive membership year. Bonuses are not redeemable for cash, not transferable, and subject to the terms below:

  • Year 1: Welcome to the Club Gift.

  • Year 2: One room upgrade or one private transfer (subject to availability, up to $75 value per household).

  • Year 3: Complimentary excursion or trip enhancement (up to $75 value per household).

  • Year 4: Custom travel keepsake (one per household, up to $75 value per household).

  • Year 5+: Invitation to a Signature Hosted Experience at a discounted rate (up to $299 per paying household).
     

Additional Notes:
4.1. Loyalty bonuses may not be exchanged for monetary value.
4.2. Loyalty bonuses expire at the end of the applicable membership year if not redeemed, except Year 5’s bonus which may be saved for up to 3 years.
4.3. Rewards are subject to vendor availability and provided on a goodwill basis. Children are not eligible; Members are responsible for childcare or additional costs exceeding provided values.

5. Membership Limitations

5.1. Membership does not guarantee travel availability, supplier perks, or upgrades, which are subject to third-party policies and capacity.
5.2. Membership perks and loyalty rewards have no independent monetary value and cannot be sold or bartered.
5.3. Gold Horizon Travel reserves the right to substitute gifts, perks, or rewards of equal or greater value at its discretion.

 

6. Termination of Membership

6.1. Gold Horizon Travel reserves the right to terminate Membership at any time, for any reason, with no refund.
6.2. Members may cancel at any time by providing written notice. No prorated refunds will be issued.
6.3. Termination does not relieve Members of any outstanding balances owed to Gold Horizon Travel or travel suppliers.

7. Modifications & Governing Terms

7.1. Gold Horizon Travel reserves the right to amend, suspend, or terminate the program at any time.
7.2. Changes will be communicated via email or posted on our website. Continued participation constitutes acceptance of revised terms.
7.3. These Terms & Conditions are supplemental to and incorporate by reference the Gold Horizon Travel, LLC – Terms & Conditions.
